Our Commitment to Your Privacy
Protecting your company account and customer data is an important part of how we operate. This policy leads you through how we collect, store, use, and protect your information.
We manage data in line with local rules, including the Individual Privacy Act, 2075 and guidelines issued from time to time by the Nepal Telecommunications Authority (NTA).
When you sign up for an account or use our messaging portal, API, or related services, you are agreeing to the practices we explain in this policy.
What We Collect
We only gather basic information to verify your business and get your messages delivered safely. When you register for a Nest SMS account, we ask for company registration documents, PAN/VAT details, contact information, and login credentials to verify your business account. In some situations, our support team might request additional business verification papers to help us prevent fraudulent accounts from gaining access to our network gateway.
To deliver messages properly, our systems process recipient mobile numbers, SMS content, timestamps, and delivery-related metadata. We also gather technical logs automatically, such as IP addresses and system portal requests, so we can keep our system stable and check for abnormal activity. Depending on regulatory requirements, some technical logs are retained temporarily for troubleshooting, billing verification, abuse prevention, or telecom compliance purposes.
How Your Data Is Used
We use your information to deliver SMS campaigns, OTPs, alerts, and service notifications through local telecom networks like Nepal Telecom (NTC) and Ncell. Certain account and traffic data are also used to maintain billing records, monitor abnormal activity, and help prevent spam or unauthorized access.
Our system monitors gateway traffic to protect the platform from automated requests, unauthorized login attempts, and general gateway congestion. We also analyze metadata where necessary to block international bypass scams and ensure compliance with NTA routing policies.
Sharing & Disclosures
We never sell, trade, or rent your subscriber lists or database logs to third-party marketing companies under any circumstances. However, to deliver your messages, we must share the recipient's phone number and message text with local telecom networks (NTC and Ncell) as part of the standard transmission process.
Because our platform is regulated, telecom operators and the NTA can audit gateway traffic to verify compliance. In these situations, we sometimes share basic routing logs or ask you to provide proof of subscriber consent if a delivery is flagged.
Under Nepal’s Electronic Transactions Act, 2063 and other local laws, if authorities like the Nepal Police Cyber Bureau open an official investigation into spam or malicious activity, we cooperate and share system logs.
Service Protection & Monitoring
Protecting your API keys, account passwords, and messaging records is a primary focus for our team. We use technical security measures to help prevent unauthorized access, accidental exposure, or data leaks. Our internal teams only access your messaging data when absolutely necessary for platform maintenance or compliance.
To protect platform security and prevent misuse, Nest SMS reserves the right to review message activity, logs, or related metadata for security, compliance, fraud prevention, service protection, or regulatory requirements.
Retention, Deletion & Your Rights
We store your business and messaging details for as long as you use Nest SMS, or as required under Nepal's telecommunications archival rules. When our agreement ends, we securely remove or anonymize eligible customer data where permitted under applicable regulations, though some technical transaction logs must be held for legal and billing audits.
Under local privacy laws, you have the right to request access to the business profile details we store. If your company registration or PAN information changes, you can reach out to our team, and we will update your business records.
Policy Updates
We update this Privacy Policy from time to time to align with new telecom technologies, mobile operator rules, or updated directives from the NTA. If we make major adjustments, we will notify you through your customer portal or email. Using Nest SMS after these updates means you accept the revised policy terms.
